VocaSwipe — Terms of Use

1. Acceptance of Terms

By downloading, installing, or using VocaSwipe ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legal agreement between you and Callisto Ventures ("we," "us," or "our").

2. Description of Service

VocaSwipe is an AI-powered Spanish vocabulary learning application. The App uses spaced repetition algorithms and adaptive difficulty to help users learn and retain Spanish vocabulary through a swipe-based card interface. The App is available on iOS and Android devices.

3. Subscription Terms

VocaSwipe offers the following auto-renewable subscription:

3.1 VocaSwipe Pro Plans

VocaSwipe Pro is available in three auto-renewable subscription options:

• Weekly: $2.99 per week
• Monthly: $8.49 per month
• Yearly: $70.99 per year ($5.92/month effective)

All Pro plans include: unlimited words per day, no ads, cloud sync, level projections, and detailed analytics.

3.2 Billing

• Payment is charged to your Apple ID account (App Store) or Google Play account at confirmation of purchase.
• Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current billing period.
• Your account is charged for renewal within 24 hours prior to the end of the current period at the same price.
• You can manage your subscription and turn off auto-renewal in your device's Account Settings after purchase.

3.3 Free Trial

If a free trial is offered, it will be clearly indicated at the time of purchase. Any unused portion of a free trial period is forfeited when you purchase a subscription. After the free trial ends, the subscription will automatically convert to a paid subscription at the stated price unless cancelled at least 24 hours before the trial period ends.

3.4 Cancellation

You may cancel your subscription at any time through your device's subscription management settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods. Refund requests should be directed to Apple (App Store) or Google (Google Play) as applicable.

4. User Accounts

You may create an account using email, Google Sign-In, or Apple Sign In. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information during registration and to update it as necessary.

5. Acceptable Use

You agree not to:

• Use the App in any way that violates applicable laws or regulations
• Attempt to reverse engineer, decompile, or disassemble the App
• Interfere with or disrupt the App's servers or services
• Use automated systems to access the App in a manner that sends more requests than a human could reasonably produce
• Share your account credentials with third parties

6. Intellectual Property

All content in the App — including text, graphics, logos, icons, vocabulary data, algorithms, and software — is the property of Callisto Ventures or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to the practices described in the Privacy Policy.

8. Third-Party Services

The App integrates with third-party services including Firebase (authentication and analytics), Google AdMob (advertising for free-tier users), RevenueCat (subscription management), and Apple Sign In. Each service has its own terms and privacy policies. We are not responsible for the practices of these third-party services.

9. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis. Callisto Ventures makes no warranties, expressed or implied, regarding the App's operation, accuracy, reliability, or availability. We do not guarantee that the App will be error-free or uninterrupted. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

In no event shall Callisto Ventures, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including but not limited to loss of data, loss of profits, or interruption of service, even if we have been advised of the possibility of such damages.

11. Termination

We reserve the right to suspend or terminate your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the App ceases immediately. You may delete your account at any time through the App's Settings.

12. Changes to Terms

We may update these Terms from time to time. Changes will be posted at this URL with an updated "Last Updated" date. Continued use of the App after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
